Samsung Class Action Claims Consumers Confused About Water Resistance Of Galaxy Watch Active 2 Smartwatch - Top Class Actions

Samsung Electronics America takes advantage of most consumers’ inability to differentiate between “water-resistant” and “waterproof” by marketing its Galaxy Watch Active 2 smartwatch as the former, a new class action lawsuit alleges. 

Plaintiff Nic Dahlquist claims that since most consumers’ don’t know the difference between “water-resistant” and “waterproof,” Samsung is being misleading with its marketing tactics. 

Dahlquist argues that consumers “demand” that their smartwatches have water-resistant features since water damage can lead to a need for expensive repairs or replacements. Dahlquist says this is akin to a “hidden tax” that he claims costs American consumers more than $10 billion annually. 

Further, Dahlquist claims that one-third of all smart watch failures are the result of water damaging the device. 

“Aside from longer battery life and shatterproof screens, water resistance has become a key smart watch feature in demand by consumers,” the class action lawsuit states. 

Dahlquist claims that, even though Samsung describes the Galaxy Watch Active 2 smartwatch as being water-resistant, its marketing would actually imply that it is waterproof. 

“Defendant takes advantage of reasonable consumers’ inability to distinguish between the two terms through marketing practices that superimpose the term ‘water-resistant’ against a backdrop of visuals and statements that imply the Product is waterproof,” the class action lawsuit states. 

Dahlquist claims Samsung is guilty of unjust enrichment, among other things, and in violation of the Magnuson-Moss Warranty Act and California’s Consumer Legal Remedies Act, False Advertising Law and Unfair Competition Law. 

Dahlquist wants to represent a California class of consumers who have purchased a Galaxy Watch Active 2 smartwatch for personal or household use. He is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory and punitive damages for himself and all class members. 

A separate class action lawsuit was filed against Samsung in January by a consumer alleging the company’s “fingerprint-resistant” and “black stainless steel” kitchen appliances are actually just regular stainless steel.

why doesnt samsung get sued for promising the ability to take blood pressure readings and never delivering? My galaxy active 2 is already falling apart (the sensor on the bottom keeps falling off) so I will likely never get the feature for which I purchased the watch.

I have had the Samsung Galaxy 2 and Galaxy 4 watches and they clearly have a design flaw which the company is not addressing. Both have quit on me in less than a year’s time. The repair department says my warranty is voided because the watch was exposed to moisture. I don’t bathe, or swim with it and have never even been caught in the rain. The only thing I’ve done is sweat while working out. This watch is marketed as a fitness tool for people to wear when they work out. Yet it can’t even handle sweat! Add me to the lawsuit please!

Currently disputing their claim of water resistant as my Galaxy 4 watch stopped working after washing my hands. 090922 Samsung received my watch for repair. Samsung has informed me my watch is out of warranty due to water damage. I have been currently disputing this claim with them because not only have I never showered or swam with the watch as they claim you can do, but also the watch has never been dropped or banged – no exterior damage at all, which they in fact noted. The repair engineer told me that I was supposed to use the lock mode when washing my hands. Really! I told him that was absurd to have to lock your watch every time you use the bathroom. How can Samsung get away with false advertising like this – that their product is water resistant? Please add me!

I have the active 2 watch

Add me. I have had the Active 2 actually 2 of them as they were used for swimming and Samsung told me they had salt water in them of which they were never near a beach.

Add me too. The 4 watch is the same. Marketed as water resistant but breaks after use with waterlock mode, even though it’s used exactly as specified and under 30 minutes. The warranty will not cover water damage and the cost of repair is almost $200. Samsung is deceptive and makes false claims.

I also made this exact complaint last year. They told me that the watch wasn’t covered because it’s not water resistant even tho that’s the main reason I bought the watch so I could track my swimming then not even 6 months later it broke because of water damage

The watch is garbage. Why have swim mode on the watch if it can’t handle swimming. Add me to the lawsuit.

I used mine in the pool. It says you can use it while swimming to keep track of your laps. So I wore it in the pool and it started freaking out and turned black. Never worked again. I called sprint who is our cell phone provider and they said it’s not waterproof it’s water resistant. How the hell can you use the watch to keep track of laps if its not waterproof??? I ended up having to buy a new watch.

I took mine swimming and it shut off. It said Rebooting for over an hour and then for it to “turn on” and be at dead battery. Fully charged it and it never turned on. What. A. WASTE!

add me also. says on their website can be in water for up to 30 minutes and 50 meters wore it in shower (which also says you can do ) and now broken. sent in for repair and said would cost me 176 to get fixed smh

I bought 4 of theses watches for each of my family memebers. 2 I can’t use because the screen stopped responding to touch! It’s NOT WATER DAMAGE unless you consider sweat as water. The one stopped working after a workout. The second one that stopped responding was just worn for the convenience during work (paper filing) So I call BS on it being water damage. Buy my watches back cause being an Active 2 is worthless.

I got mine when they first came out and have never had a problem. The only time I don’t have it on is when it is charging. I wear it in the shower and while swimming. I couldn’t be happier with it.

I have one and it hasn’t broken in the year I’ve had it. I wash my hands with it on frequently and have even bathed my dog on multiple occasions while wearing it. There is a water-lock feature most people (including third party sales reps) don’t bother to learn about. I think this is a matter of researching your tech before you invest. To my knowledge, it was never advertised as water-proof, only resistant, and it’s not the company’s fault if people don’t know/bother to find out the difference. Accidental damage is what insurance is for. If you don’t want to research your new toy, and don’t want to deal with a broken one, I recommend a protection plan.

My watch was also damaged by water.

I own a Samsung galaxy Active 2 watch, it’s been losing battery life. I work with water, and have gotten it wet, and it acts up…I have a protector over it, and have to remove it, and make sure the watch itself is dry.
